The Inn's attorneys have successfully handled a variety of cases with excellent results. Here is a summary of our experience and accomplishments.

Arbitration

The Inn has for decades enforced the arbitration requirements of a California HMO, defended provider and patient arbitrations, as well as defending arbitration awards against court challenges. The firm's notable recent successes include Ruiz v. Podolsky, 50 Cal.4th 838 (2010) (amicus curiae),Toledo v. Kaiser Permanente Medical Group, 987 F.Supp.1174 (N.D. Cal. 1997), Clay v. The Permanente Medical Group, Inc., 540 F.Supp.2d 1101 (N.D. Cal. 2007), Drissi v. Kaiser Foundation Hospitals, 543 F.Supp.2d 1076 (N.D. Cal. 2008); Kuntz v. Kaiser Foundation Hospital, 62 Cal.App.5th 1135 (2021), Winninger v. Scott, No. 21-cv-04689-HSG, 2022 U.S. Dist. Lexis 117756 (N.D. Cal. 2022), and Perez v. Kaiser Foundation Health Plan, Inc., 91 Cal.App.5th 645 (2023).

Hospital- Health Plan Coverage Disputes

The Inn has extensive experience in litigating payment and coverage disputes between a California health maintenance organization and hospitals, other health care providers and patients. Notable court decisions include Children’s Hosp. Cent. California v. Blue Cross of California, 226 Cal.App.4th 1260 (2014) (amicus curiae) (leading California decision on standards for valuing non-contracted emergency care, cited as of 5/30/2025 in 81 court decisions), and Prime Healthcare La Palma, LLC v. Kaiser Found. Health Plan, Inc., Ct. App. No. B296487, 2021 WL 3750674 (Aug. 25, 2021) (unpublished).

Real Estate, Land Use and Landlord-Tenant

The Inn has successfully litigated a variety of construction disputes on behalf of both owners and contractors. When PG&E sought to construct an overhead high voltage transmission line over a client’s ranch property in the Pleasanton area, the firm successfully persuaded the California Public Utilities Commission to require PG&E to construct the longest underground line in the United States. We have successfully challenged a large oil firm’s effort to place a pipeline on the client’s ranch land under the California Environmental Quality Act . We have handled a variety of commercial and residential landlord-tenant matters for both landlords and tenants.

General Commercial Litigation

We have been pleased to represent a wide spectrum of clients in a variety of general commercial disputes. These cases have included partnership / corporate dissolution disputes, disputes between hospitals and a managed care organization, and disputes between banks and commercial account holders.

Insurance

The Inn's attorneys have often been retained to litigate and advise on insurance coverage disputes. The firm's trial and appellate victories have ranged from issues of health insurance coverage to specialized issues of coordination of benefits, and subrogation / third party liability.
